GSMA Feedback on the draft FSR Guidelines

The GSMA welcomes the European Commission’s initiative to provide more guidance on the way it assesses potentially distortive foreign subsidies.  However, we believe there is room for providing greater transparency and simplification.

We ask the Commission:

• To set proportionate standards of proof for all parties involved in the analysis
• To apply a balanced and cautious approach when exercising its margin for intervention, particularly in public procurement procedures and below-the-threshold concentrations
• In its upcoming review of the FSR, to ease the burden associated with monitoring and reporting foreign financial contributions
